The new guidance
The guidance, numbered ALLM 2026:04, was issued under the Spellag 2018:1138 authority and runs alongside existing moderation-and-risk messaging rules. It explicitly extends the 'måttfullhet' moderation standard to any Swedish-language promotion appearing on a social platform, regardless of whether the publisher is a licensed operator, an affiliate under contract, or an influencer paid per post.
Under the previous reading, influencer posts had been treated as a grey zone if the influencer did not have a direct commercial relationship with the licensee. Spelinspektionen has now said any paid or value-exchange promotion, including free play credits and comped trips to events, falls inside the advertising perimeter.
What counts as influencer promotion
The guidance lists four triggers. First, any monetary payment, however structured. Second, any non-cash value exchange including bonuses, event access or merchandise. Third, any affiliate tracking link, even if posted without disclosure. Fourth, any post identifying a specific operator by name where the influencer has disclosed any form of relationship with the brand in the preceding 180 days.
The fourth trigger is the one worrying influencer management agencies. It captures the common pattern where a creator posts an unpaid stream in July, signs a one-off deal with the same brand in August, then posts an apparently organic follow-up in September. Under the new guidance, the September post still counts as a promotion and is bound by the moderation standard.
How this layers onto the 2018 code
The Spelbranschens Advertising Code of 2018 was industry self-regulation, with sanctions limited to membership standing in the trade body. ALLM 2026:04 puts the same principles under Spelinspektionen's sanctioning authority, which can issue warnings, fines of up to SEK 80 million, and in extreme cases trigger a licence review.
A Spelinspektionen spokesperson told Flinke the shift is about enforcement teeth. 'The industry code did useful work,' she said. 'But a reputational sanction does not reach a creator who is not inside the trade body. ALLM 2026:04 means Spelinspektionen can act directly on the operator paying for the promotion, regardless of the publisher.'
The SEK 5,000 deposit limit is still there
All of this sits on top of the SEK 5,000 monthly deposit cap that has defined regulated Swedish online gambling since the pandemic. The cap is under separate consultation that we covered when Spelinspektionen opened its review in August 2026, with a decision not expected before Q1 2027.
The combined effect on the Swedish licensed market is cumulative pressure. The deposit cap limits the top of the funnel. The advertising rules limit the shape and reach of the acquisition funnel itself. Channelization, the share of Swedish online gambling happening at licensed operators, is now under 70% by BOS's own count.
Swedish players looking offshore
The predictable response to a tighter domestic regime is that higher-stake Swedish players look to non-SE licensed brands. Our utländska casino guide covers how that market is structured, which licences are worth trusting, and where the real consumer-protection gaps are.
The offshore pull is not a free lunch. Dispute-resolution channels, self-exclusion cross-operator links and bonus protection are all weaker outside the Spelinspektionen framework. We log payout times for both sides of the market and the gap is real: licensed Swedish operators median 2 hours, offshore brands median 11 hours on the same methodology.
The enforcement questions that remain
ALLM 2026:04 is a guidance document, not a statute. The operative sanctioning power sits in the Spellag, which gives Spelinspektionen discretion. The open question is how aggressively the regulator will pursue cross-border creators who have no Swedish legal nexus but whose content reaches Swedish audiences via platform recommendation.
Spelinspektionen told us enforcement will prioritise paying operators rather than creators, since the operator licence is the enforceable attachment point. Creators still face platform-level risk, since TikTok and YouTube already act on regulator notices in Sweden.
Frequently asked questions
Does ALLM 2026:04 ban influencer casino promotion in Sweden?
No. It subjects influencer promotion to the same moderation standard that already binds operator advertising, and gives Spelinspektionen direct sanctioning power over the paying operator.
What is the SEK 5,000 cap?
A monthly deposit limit, applied across every Spelinspektionen-licensed operator. A player hits it once per calendar month and cannot deposit more at any licensed Swedish brand that month.
Is the deposit cap also changing?
A separate consultation is open on raising or restructuring the cap. A formal decision is not expected before Q1 2027.
What should I do if I want to bet above the cap?
You have two legal routes: a Swedish licensed operator with the cap in place, or an offshore brand outside the Spelinspektionen framework. The trade-off is weaker consumer protection on the offshore side.
